Service fees are as quoted during the consultation process. All fees are in U.S. dollars. Payment terms, refund policies, and billing schedules will be outlined in individual service agreements provided upon tier selection.
To the fullest extent permitted by Oregon law, Ember Information Systems shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or related to the use of our services. Our total liability shall not exceed the amount paid by you for the specific service giving rise to the claim.
Our services are provided "as is" and "as available." We make no warranties, express or implied, regarding the accuracy, completeness, reliability, or suitability of our diagnostic outputs, reports, or recommendations for any particular purpose.
These Terms shall be governed by and construed in accordance with the laws of the State of Oregon, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Multnomah County, Oregon.

These terms govern your use of all AI-powered services operated by Ember Information Systems ("EIS"), including but not limited to DISCERN, CHLOE, EBONY, SENTINEL, and any future AI-driven tools or agents made available through EIS platforms. By acknowledging these terms, you agree to be bound by all conditions herein in addition to the general Terms of Service above.
You acknowledge and understand that:
Information you submit to EIS AI services may be processed to generate your results. By submitting data, you represent that you have the legal right to share such information and grant EIS a limited license to process it solely for service delivery. EIS does not use your submitted data to train AI models or share it with third parties except as required for service operation or by law.
EIS makes no guarantee that AI-generated recommendations will achieve any particular business outcome, security result, or other objective. Diagnostic scores, visibility ratings, and strategic suggestions are estimates based on available data at the time of analysis and may change as conditions evolve.
You may not use EIS AI services to:
In addition to the general limitations of liability described above, EIS expressly disclaims all liability for decisions made in reliance on AI-generated outputs. You assume all risk associated with your use of EIS AI services. EIS's total liability for any claim arising from AI service use shall not exceed any fees paid by you for the specific service in the prior 30 days, or $50, whichever is greater.
EIS reserves the right to modify, suspend, or discontinue any AI service at any time without notice. EIS may update these AI Services Terms at any time; continued use after updates constitutes acceptance. Significant changes will be reflected in an updated "Last Updated" date above.
